1. Who you are contracting with

These Terms form an agreement between you and AutoMind AI(trading as "AutoMind AI", "we", "us", or "our"), who provides the AutoMind AI service (the "Service").

2. Acceptance

By creating an account or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are of legal age and, if signing up on behalf of an organisation, that you have authority to bind it.

3. The Service

AutoMind AI provides AI-assisted vehicle diagnosis, maintenance tracking, pre-purchase checks, and related tools. Outputs may be inaccurate or incomplete and are not a substitute for inspection or advice by a qualified mechanic. You are responsible for verifying any information before acting on it.

4. Acceptable use

You must not misuse the Service. In particular, you must not:

  • Use it for any unlawful, fraudulent, deceptive, or harmful purpose.
  • Infringe intellectual property, privacy, or publicity rights of others.
  • Upload malware, attempt to probe, scan, or breach security, or scrape the Service.
  • Use AI features to generate illegal content, hate speech, harassment, sexual content involving minors, deepfakes, or to jailbreak safety controls.
  • Use the Service in connection with activities prohibited by our payment provider's Acceptable Use Policy, including: adult content, gambling, weapons, controlled substances, tobacco/vaping, multi-level marketing, cryptocurrency trading, get-rich-quick schemes, counterfeit goods, IP-infringing content, sanctioned-party transactions, or any activity that violates applicable card-scheme rules (Visa, Mastercard, etc.).

You are responsible for the content you submit (text, photos, videos) and confirm you have the rights to upload it. We may remove content or restrict accounts that violate these Terms.

5. Accounts

You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account.

6. Intellectual property

We (and our licensors) retain all rights, title, and interest in the Service, including the software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You may not reverse engineer, resell, or circumvent technical limits.

7. Payments, subscriptions and refunds

Paid plans are billed on a recurring basis (monthly or yearly, as selected at checkout) and automatically renew at the then-current price until you cancel. The renewal amount, currency, and cadence are shown clearly before you confirm the purchase and on every invoice. You can cancel at any time from your account settings or via paddle.net; cancellation stops future renewals and access continues until the end of the current billing period.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellations and refunds are governed by the Paddle Buyer Terms and our Refund Policy (30-day money-back guarantee).

8. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may cancel at any time from your account settings; access continues until the end of the current billing period.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties (including merchantability and fitness for a particular purpose) and do not guarantee that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where law prohibits such limitation.

11. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Brazil, the jurisdiction in which AutoMind AI is established, without regard to conflict-of-laws principles.
